MOTORCYCLE TOURS TERMS AND CONDITIONS

 

 

Please note that these terms and conditions relate to joining a RMR Adventure (rideadventure.ro) organized tour. When renting a motorcycle “only” from RMR Adventure in ROMANIA please refer to the rental agreement Terms and Conditions below the heading “Motorcycle Rental Terms & Conditions”.

Please carefully read and agree to the following terms and conditions which form part of the contract you enter into by doing one of our tours.

 

1. The trip operator is RMR Adventure SRL (rideadventure.ro) as RMR Adventure of Mihai Eminescu Street, No. 188, 3’rd floor, Bucharest, 020085, Bucharest, Romania.

2. A deposit of 10% is required to establish and hold a reservation. The full balance is due and payable thirty (30) days prior to departure. Your booking may be considered cancelled should the full balance not be received by RMR Adventure by that time.

3. Should you have to cancel your trip, we must receive notice in writing. If this is received more than thirty (30) days prior to departure, 50% of your payment will be refunded, or up to 100% at our discretion. If received with less than thirty (30) day notice, any refund will be solely at our discretion. In these circumstances, we strongly recommend that you obtain a trip cancellation insurance from an insurance company.

4. You are responsible for ensuring that you are fit and healthy enough to participate in your tour. We reserve the right to insist on a medical certificate from your doctor stating that you are in a suitable condition.

5. We reserve the right to cancel any tour if the number of participants booked does not meet the minimum requirement to operate the trip. Should that occur, your payment will be refunded in full if we are unable to transfer you to another trip to your satisfaction.

6. The tour leader has the sole discretion to alter the itinerary, should it become necessary due to weather, local conditions, politics or various other reasons. No refund will be considered in the event of any such changes.

7. RMR Adventure takes no responsibility for any flight delays or scheduled changes at any stage throughout the trip. In the event of any such change, no refund will be considered.

8. RMR Adventure insists that the participant takes out a personal travel insurance policy and it will request proof of same. It is the participant’s responsibility to ensure suitable insurance cover is taken out prior to commencement of the trip.

9. RMR Adventure is not responsible for participant’s personal effects, if they are lost, stolen or destroyed. RMR Adventure cannot be held liable for any such loss, irrespective if personal items are being carried on the RMR Adventure support vehicle / bike or lost during a shipment organized by RMR Adventure.

10. RMR Adventure does not provide a support vehicle unless a minimum number of 6 participants on a tour. In the case of being incapable to ride their motorcycle for various reasons, RMR Adventure will provide a support vehicle for the rest of the tour.

11. RMR Adventure is not responsible for any accidents. It is agreed and understood that neither RMR Adventure, nor its agents, are the guardians of any customer safety and that they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the tour which might result in injury, death or other damage to the customer, his/her property or his/her family heirs or assigns.

12. The motorcycles are provided by RMR Adventure and the cost is included in the tour costs. RMR Adventure will attempt to provide the trip participants with the model of motorcycle confirmed to the participant. If, after having confirmed the model of motorcycle requested, RMR Adventure finds that it is necessary to substitute a different model, RMR Adventure will notify the participant as soon as possible. If the participant does not wish to accept the proposed substitution, the participant may cancel the trip without penalty and the deposit will be refunded.

13. Unexpected and uncontrollable situations may require last minute substitution of a motorcycle including after the trip has begun. This may include, but is not limited to, mechanical failure, collision, damage and theft. In this circumstance, RMR Adventure reserves the right to substitute the type of motorcycle confirmed. Should RMR Adventure not be able to replace a motorcycle with the confirmed type or similar, a prorated refund for the difference in models, if any, will be refunded to the participant.

14. The motorcycle that RMR Adventure provides to the participant will be insured:

EUROPE – the participant will be liable for the first €1000 (depending on the bike model rented) worth or any damage to the motorcycle deemed by RMR Adventure to have been your responsibility. The term ‘damage’ is to exclude reasonable wear and tear. Minor blemishes or paint chips caused by gravel, stones and insects are considered normal wear and tear; however, damage or scratches caused by an accident, dropping a motorcycle or riding it through bushes or off roadways is not considered normal wear and tear. The renter understands and accepts that for any damage to the motorcycle made outside of public roads and off-road riding will be held liable for the entire damage. The participant may choose to limit their exposure to the initial €1000 (depending on the bike model rented) through the purchase of our Excess Reduction Policy (ERP)/Comprehensive vehicle insurance. This policy operates to reduce the excess to an amount of €500 by payment by the participant of a fee of €20 per day for the duration of the tour. The participant may exercise this option at the time of booking. Once the tour commences, the participant will be unable to exercise this ERP option.

15. The participant is solely responsible for the ignition keys during the normal course of a riding day. Should they be lost or stolen, due to neglect or failure to follow the tour leaders’ instructions, the participant is responsible for the replacement to a maximum cost of €500.

16. If a participant operates a motorcycle after drinking an alcoholic beverage or using mind altering drugs, the rider will incur unlimited liability for damage to the motorcycle. RMR Adventure is not obliged to replace a motorcycle damaged by a participant in these circumstances.

17. Participants who intend to operate a motorcycle provided by RMR Adventure must be at least 25 years old and must have a valid motorcycle operator license. Participants must also attest that they have at least 2 years of experience operating a motorcycle of similar size or larger than the motorcycle that will be provided by RMR Adventure.

18. If the participant does not comply with local traffic laws, or does not practice safe group travel practices, as described by the tour leader and by guidelines provided by RMR Adventure, the agreement with the rider may be cancelled and riding privileges will be suspended. Riding privileges will be suspended from anyone under the influence of drugs or alcohol. Participants agree to refrain from alcoholic beverages until the motorcycles have been parked for the night.

 

 

ACCEPTANCE OF TRIPS TERMS AND CONDITIONS

 

I understand that I will be required to sign a Release and Waiver Form before I can participate in a RMR Adventure Tour. I have read and accepted the terms of conditions of RMR Adventure. I am aware that motorcycling can be dangerous. I am aware that traffic conditions, roads, weather and other conditions, as well as the actions of other members of the trip, can influence the risks. I agree to accept those risks.

I am an experienced, responsible and healthy motorcyclist, with a valid motorcycle driver license. As a passenger, I am aware of the potential dangers of motorcycling.

I further agree and understand that the owners, operators and agents of this trip, including RMR Adventure, are not the guardians of my safety. They, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation of my participation in the trip which might result in injury, death or other damage to me, my property or my family heirs or assigns.

MOTORCYCLE RENTAL TERMS AND CONDITIONS

 

 

Please carefully read and agree to the following terms and conditions which form part of the contract you enter into by agreeing to rent a motorcycle from RMR Adventure.

 

1. The rental operator is RMR Adventure SRL (rideadventure.ro) RMR Adventure of Mihai Eminescu Street, No. 188, 3’rd floor, Bucharest, 020085, Romania

2. A deposit of 10% per person is required to establish and hold a reservation. The full balance is due one (1) week before bike collection if the bike is being delivered to your hotel or upon collection if pick up from our headquarter. Your booking may be considered cancelled should the full balance not be received by RMR Adventure by that time.

3. Should you have to cancel your trip, we must receive notice in writing. If this is received more than thirty (30) days prior to departure, the booking deposit is lost. If received with less than thirty (30) day notice, the full amount is due. In these circumstances, we strongly recommend that you obtain a trip cancellation insurance from an insurance company.

4. There shall be no pro rata refunds should the bike be returned early before the end of the hire period, irrespective of the circumstances that facilitated an early return.

5. All bikes shall be covered by third party person & property insurance. Bike insurance does not cover personal bodily injury or damage / loss of personal belongings.

6. RMR Adventure insists that the participant takes out a personal travel insurance policy and will request proof of same. It is the participant’s responsibility to ensure suitable insurance cover is taken out prior to commencement of the trip.

7. RMR Adventure is not responsible for any accidents. It is agreed and understood that neither RMR Adventure nor its agents are the guardians of any customer safety and that they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the rental which might result in injury, death or other damage to the customer, his/her property or his/her family heirs or assigns.

8. The motorcycles are provided by RMR Adventure and/or third party rental operators (differing rental terms and conditions may apply). RMR Adventure will attempt to provide the trip participants with the model of motorcycle confirmed to the participant. If, after having confirmed the model of motorcycle requested, RMR Adventure finds that it is necessary to substitute a different model, RMR Adventure will notify the participant as soon as possible. If the participant does not wish to accept the proposed substitution, the participant may cancel the trip without penalty and the deposit will be refunded.

9. Unexpected and uncontrollable situations may require last minute substitution of a motorcycle. This may include, but is not limited to, mechanical failure, collision, damage and theft. In the event of a mechanical breakdown, RMR Adventure will make every effort to provide repair facilities or a replacement motorcycle, not necessarily the same model booked. If the renter organizes their own towing, then the expenses incurred will be at the renter’s expense. Only RMR Adventure may arrange towing. If the bike has simply run out of fuel, the costs to replenish the fuel will be at the renter’s expense.

10. In the event of an accident, police and RMR Adventure must be notified immediately. If the bike cannot be ridden any further RMR Adventure, its agents, assigns and contractors are under no obligation to replace the motorcycle and no pro rata compensation can be claimed by the renter.

11. A security bond starting at EUR € 800 (depending on bike model rented), is required at time of rental collection. The security bond will be via way of credit card debit into the RMR Adventure account; the security bond will be fully refundable upon the undamaged and on-time return of bike with a full fuel tank; for bikes that are returned without a full fuel tank, an EUR €2.00 per liter fee will be charged to refuel the bike.

12. The motorcycle that RMR Adventure provides to the participant will be insured, but you will be liable for the first EUR €800 (depending on the bike model rented) insurance excess for any damage to the motorcycle, irrespective of how that is incurred, deemed by RMR Adventure to have been your responsibility. The term ‘damage’ is to exclude reasonable wear and tear. Minor blemishes or paint chips caused by gravel, stones and insects are considered normal wear and tear; however, damage or scratches caused by an accident irrespective of who is at fault, dropping a motorcycle or riding it through bushes or off roadways, is not considered normal wear and tear.  The renter understands and accepts that for any damage to the motorcycle made outside of public roads and off-road riding will be held liable for the entire damage. The participants may choose to limit their exposure to the initial EUR €800 (depending on bike model rented) insurance excess through the purchase of our Excess Reduction Policy (ERP)/Comprehensive vehicle insurance. This policy operates to reduce the insurance excess to an amount of EUR €400 by payment by the participant of a fee of EUR €20 per day for the duration of the rental. The participant may exercise this option at the time of booking. Once the rental commences, the participant will be unable to exercise this ERP option. The Excess Reduction Policy covers only public roads, and does not include off-road riding.

13. Water damage is not covered by RMR Adventure. Renters are responsible for all damage caused to motorcycle if riding through deep water or dropping bikes into water courses. NEVER ATTEMPT TO CROSS FAST FLOWING RIVERS.

14. Damage to panniers or top box is not covered under the bikes insurance and any damage not considered to be reasonable wear and tear shall be deducted from the security bond.

14.1. The renter agrees that if he/she is delivering the bike to another destination, other than RMR Adventure head office in Bucharest at the end of the rental term agreement, then RMR Adventure reserves the right to hold the renters credit card details for 14 days to allow the bike to be returned to us for damage inspection. The renter will be contacted prior to any credit card charges being made, if damage is present.

15. The renter is solely responsible for the ignition keys during the normal course of a riding day. Should they be lost or stolen due to neglect, the renter is responsible for the replacement to a maximum cost of EUR €500. Additionally, the renter is liable for any costs to send spare keys to renter.

15.1. The renter is solely responsible for the Flat Tire Kit, GPS, Mobile Phone, clothing & helmet (if rented), if lost or stolen. Should they be lost or stolen due to neglect, the renter is responsible for the replacement to the cost of the equipment. If stolen, please ensure you get a police report for your insurance.

16. If a participant operates a motorcycle after drinking an alcoholic beverage or using mind altering drugs, the rider will incur unlimited liability for damage to the motorcycle and/or third party property. RMR Adventure is not obliged to replace a motorcycle damaged by a participant in these circumstances.

17. Participants who intend to operate a motorcycle provided by RMR Adventure must be at least 21 years old and must have a valid motorcycle operator license. Participants must also attest that they have at least 2 years of experience operating a motorcycle of similar size or larger than the motorcycle that will be provided by RMR Adventure.

18. If the participant does not comply with local traffic laws, or does not practice safe riding practices, as described by the guidelines provided by RMR Adventure, the agreement with the rider may be cancelled and riding privileges will be suspended. Riding privileges will be suspended from anyone under the influence of drugs or alcohol. Participants agree to refrain from alcoholic beverages until the motorcycles have been parked for the night.

19. The renter is liable for all parking tickets, speeding fines and other penalties. The renter is also liable for all tolls incurred during the rental period. A €50 processing fee will be imposed for unpaid fines and a EUR €30 fee for an unpaid toll.

20. All bikes will begin the rental period with new or near new consumables. Minimum preventative maintenance must be carried out during the course of the rental period. Oil/water must be checked daily, as must operation of all lights, indicators and horn. Chain (if chain driven) must be checked for tension and lubricated daily. RMR Adventure will provide supplies for this basic maintenance.

21. By agreeing to these terms and conditions, you agree to Romanian state and territory road traffic rules. You will not ride the bike on beaches, salt lakes, wet or dry or tidal estuaries. You will not ride the bike on closed public roads. When riding in remote areas, you agree to inform RMR Adventure of your proposed itinerary and take the necessary precautions for any such remote riding activity.

22. I understand that I will be required to sign a Release and Waiver Form before I can participate in a RMR Adventure rental. I have read and accepted the RMR Adventure terms and conditions.  I am aware that motorcycling can be dangerous. I am aware that traffic conditions, roads, weather and other conditions, as well as the actions of other road users, can influence the risks. I agree to accept those risks. I am an experienced, responsible and healthy motorcyclist, with a valid Romanian or international motorcycle driver’s license. As a passenger, I am aware of the potential dangers of motorcycling.

23. I further agree and understand that the owners, operators and agents of this rental, including RMR Adventure, are not the guardians of my safety. They, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation or my participation in the rental which might result in injury, death or other damage to me, my property or my family.
